Can restaurants in NH offer Can I use DoorDash or another third party delivery service? What are the requirements to offer beer and wine delivery? 

No. New Hampshire law specifically states that only W-2 employees of the restaurant, who are at least 21 years of age, are allowed to deliver beer and wine with food.


 Am I required to have a license to offer been and wine delivery? 

Yes. A $250 annual license, the Restaurant Delivery License (RDL), is required in order to deliver or offer take out of beer and wine. Employees handling deliveries must have a copy of the delivery permit in the vehicle used to deliver the food and alcohol, and they need to produce a copy of it when requested by a liquor investigator or police officer.


Are there other requirements to be aware of? 

Yes. We suggest reviewing the 179:15 Transportation of Beverages and Wine for all requirements, but a few to be aware of are:


  • All deliveries must be accompanied by food.

  • The person making the delivery must acquire a signed receipt from the consumer.

  • Consumers cannot be served if they appear visibly intoxicated or who a reasonable and prudent person would know are intoxicated, who do not produce identification verifying the consumer's age, or who fail to sign a receipt shall not be entitled to their delivery of beer or wine.
