Safety Summary Form
The Law requires that all businesses with 5 or more employees, establish a joint loss management committee comprised of an equal number of employee and management representatives. Additionally, any employer with 10 or more employees is required to file a Safety Summary Form with the NH Dept. of Labor (DOL) every other year. If you last filed in the year 2007, then you are due to file again by January 1, 2009. This version of the form gives you the opportunity to print and complete before filing online with the DOL. If you have difficulty with the online filing feature, simply print the form and send it via the postal service to the address on the form.

This will bring you directly to the NH Department of Labor’s workers’ compensation website. All forms required for filing claims are available for downloading.

Claims Filing
Complete the Employer’s First Report of Injury (please include all pertinent information and indicate whether the employee has or has not returned to work); E-mail or fax (see contact information below) the completed form to NHMTA services and they will electronically file the report for you with the NH Department of Labor.

Introduction
In response to the concern of its membership about Workers' Compensation Insurance, the New Hampshire Lodging and Restaurant Association has created a program designed specifically for the hospitality industry. The New Hampshire Hospitality Compensation Trust, under which the members can pool the risks of their Workers' Compensation liabilities, was created in 1994. This program, authorized by the laws of the New Hampshire Department of Labor, is a valuable member benefit alternative to purchasing commercial insurance.

Savings
Participants pay premiums consistent with commercial workers' compensation insurance rates. Pooling together the premiums of all members creates a fund large enough to spread and share the risks, which cannot be achieved by any single member. The premiums are invested to generate interest income (versus paying premiums to an insurance company), until needed to pay claims. Since claims are paid over a long period of time, invested funds can generate substantial dividends for the participants. The Trust operates on a not-for-profit basis; therefore all money not used to pay claims or related expenses is returned to the members, as directed by the Board of Trustees and approved by the Department of Labor.

Control of the Program
The New Hampshire Hospitality Compensation Trust is supervised by the Board of Trustees, composed of representatives who are Trust Members. This assures that the program is operated in the best interest of the Trust participants.

Insurance Protection
Every member of the Trust is a beneficiary of the Trust. State law mandates that each and every member is jointly and severally liable for any obligations that occur during the term of the MemberÕs participation in the Trust. To reduce risk and as required by law, a reinsurance policy is in effect to establish a limit on the maximum liability of the Trust in any given year.

Workers' Compensation Act Protection
As members of the New Hampshire Hospitality Compensation Trust, your employees retain all rights and benefits under the New Hampshire Workers' Compensation Act, administered by the New Hampshire Department of Labor.

How The Program is Serviced
NHMTA SERVICES, INC. acts as the Third Party Administrator for the Trust. They provide complete claims administration which includes all necessary investigation of claims, required filings with state agencies, payment of medical costs, and payment of disability benefits. NHMTA SERVICES, INC. acts on the possibilities of subrogation, or third party actions, and takes the necessary steps to see that all potential recoveries are made, including Job Modification and Second Injury Funds. NHMTA SERVICES, INC. also provides members with periodic reports detailing all data relative to the member's claims.

Loss prevention educational sessions will be provided by NHHCT in cooperation with NHLRA to provide practical information for members. A web based loss prevention program available through the TrustÕs reinsurer - Midwest Employers Casualty Corporation - will be availalbe for Trust members in the 2008 Fund Year. (Please make sure that NHMTA Services has your e-mail address.) Additionally, specific loss prevention services are available to individual members on an as needed basis. These services will assist the members in providing a safer work environment for their employees, thereby reducing accidents and their related costs.

Managed Care
Managed care is provided on a case by case basis as required to help manage high cost claims. A nurse case manager may be assigned to assist in the oversight of these claims.

Summary
By joining together, members of the New Hampshire Hospitality Compensation Trust participate in a program that meets their obligations under the New Hampshire Workers' Compensation Act at a competitive cost, while providing professional, cost effective claims administration and loss control services to its members and their employees.

Eligibility
Any food service or lodging related business which is a member in good standing of the New Hampshire Lodging and Restaurant Association, has good loss experience, and meets the underwriting requirements of the Trust, may apply for participation in the Trust.
